Pyoopl Privacy Notice

Please read this Privacy Notice carefully. It provides important information about your personal data. It also tells you about your rights under applicable privacy laws.   1. Introduction­­

Pyoopl, LLC, a Texas limited liability corporation (collectively, “Pyoopl”, “we,” “our” or “us”), owns and operates the Pyoopl mobile application (the “App”) that provides users an online Internet community designed for access and use by college students.

This Privacy Notice (“Privacy Notice”) is intended to help you better understand how we process your personal information, and governs how Pyoopl may use, transfer, store and disclose personal information that we collect when:

When we refer to the “Services” throughout this Privacy Notice, we mean, collectively, the App, the Site and any related services provided by us to you in connection with your use of the App and/or Site.

  1. Updates to this Privacy Notice

Pyoopl may need to update this Privacy Notice from time to time. If so, we will post an updated Privacy Notice on the Site along with a change notice on the Site, as well as a notification through the user interface of the App that this Privacy Notice has been updated. If we make material changes, we may also send registered users a notice that this Privacy Notice has been changed to the email account we have on file for such users, and/or a notification through the user interface of the App that the Privacy Notice has been updated. Where express consent is required by applicable law for the lawful collection, use, or disclosure of information about you, we will obtain that consent. We encourage you to review this Privacy Notice regularly for any changes. Your continued use of the Services and/or your continued provision of personal data to us after the posting of such notice will be subject to the terms of the then-current Privacy Notice.

  1. Personal Information We Collect from You

Personal data, or personal information, means any information about an individual from which that person may be identified. For example, it may include your name, telephone number, email address, or payment information, and in some jurisdictions your IP address. It does not include data from which the identity of an individual has been definitively removed along with any identifiers connected to such individual (also known as anonymous or anonymized data).

IMPORTANT – PLEASE NOTE if you provide personal data to us about someone else, you must ensure that you have the right to disclose that information to us and that the individual concerned is aware of the terms detailed in this Privacy Notice.  We will collect, use and disclose such information as described in this Privacy Notice.

Information Collected Directly

How we collect personal information directly from you depends on how and why you use the Site and/or Apps. For instance, the information that you provide when you visit our Site is more limited than the information that you provide if you use the Apps.

With respect to the data that Pyoopl collects directly from you, we have divided this section into two parts in order to better explain the circumstances where personal information may be collected, as well as the types of data collected:

  1. Registration and Profile Information
    • Your identity, including your first name, last name;
    • Your email address;
    • Your username and password;
    • Your contact details, including your postal address and email address;
    • Your gender;
    • Your preferences.

Unless you have set your preferences to hide certain profile data, other users of our Services will be able to view your profile data, which may include your name, age, gender and State, and any other information you have listed as “publicly visible” to users who have connected with through the Services.

  1. Photos, Videos, Content

You may upload photos, videos and other content on the Services. We collect this data that you choose to upload to the Services.

Please be aware that if you do this then your photos, videos and other content that you post may be viewed by other users of the Services. You may remove your photo(s), videos and other content at any time by going to your account, selecting your content, and deleting content.

If you are a minor between the ages of 13 and 18, you may contact us via our help center to remove certain content that you have submitted on the Services.

If you use the chat functionality, message board or instant messages on the Services, you should be aware that any personal data you submit there­­­ can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personal data or information that you choose to submit in these forums.

Any other information you may provide by filling out forms or by contacting us (such as your feedback or other communications with us).

Information Collected Indirectly

  1. Geolocation Information

Certain features and functionalities of the App are based on your location. In order to provide these features and functionalities while you are using your mobile device, we may, with your consent, automatically collect geolocational information from your mobile device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”). Collection of such Geolocational Information occurs only when the App is running on your device. You may decline to allow us to collect such Geolocational Information, in which case we will not be able to provide certain features or functionalities to you.

  1. Tracked Information

We may track the total number of visitors to the Site and/or App, the number of visitors to each page of the Site and/or App, browser type, IP addresses, and device id's, UDID's and we may analyze this data for trends and statistics. We may also use such information to administer and improve the Services, analyze trends, track users' use of the Services, and gather broad demographic information for aggregate use.

A cookie is a small text file that is stored on a user's computer for record-keeping purposes. When you visit or access the Services, we may by means of cookies, beacons, tags, scripts, and/or similar technologies automatically collect technical information about the devices and software you use to access the Services, such as the type of Internet browser or mobile device you use, the website or source that linked or referred you to the Services, your IP address or device ID (or other persistent identifier that uniquely identifies your computer or mobile device on the Internet), the operating system of your computer or mobile device, and other similar technical information.

We use both session ID cookies and persistent cookies. Pyoopl tracks users use of the Services, but does not track users across third party websites.

We may use third party tools and technologies to help us gather this information discussed above. For instance, we use Fabric and Firebase, products provided by Google, Inc., which includes, Google Analytics to collect and process certain analytics data with technologies such as tracking pixels.

Google provides some additional privacy options described at www.google.com/policies/privacy/partners/ with respect to Google Analytics cookies. To opt out from Google Analytics, you can download a plug-in from http://tools.google.com/dlpage/gaoptout.

Typically, all technical, analytics, and usage information is gathered by Pyoopl in anonymous form and does not identify you personally.

  1. Your Choices

Most web and mobile device browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set. You can also learn more about cookies by visiting www.allaboutcookies.org which includes additional useful information on cookies and how to block cookies using different types of browsers or mobile devices.

Please note, however, that by blocking or deleting cookies used on the Services, you may not be able to take full advantage of the Services and you may not be able to properly log on to the Services.

Pyoopl does not process or respond to web browsers' "do not track" signals or other similar transmissions that indicate a request to disable online tracking of users who use our Services.

  1. Sensitive Data

Pyoopl does not require you to provide any sensitive data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic, and biometric data to use the Services.

  1. Children’s Privacy

Use of the Services is not intended for individuals under the age of 18. Without limiting the foregoing, Pyoopl does not target the Services to persons under the age of 18 and does not knowingly collect personal data from minors. Therefore, we ask you not to provide us with personal information of persons under the age of 18. If we learn that personal information of persons under 18 years of age has been collected on or through the Services, then we may deactivate the account or otherwise terminate access to the Services and/or make the user content inaccessible.

  1. How We Use Your Data

We may use any of your personal data to ensure that our Services are operational and for optimal user experience, as well as to enforce our terms of use with you. For example, we use your personal data to in connection with your request to register to access and use the Services and to contact you to provide certain information you have requested and/or respond to your communications to us.

We use your personal data to improve the content and general administration of the Services, provide you with customer support, improve the Services and to detect fraud, illegal activities or security breaches.

Additionally, Pyoopl may also collect information collected indirectly as described above and such other non-personal data as statistics about machines running our Services, so as to further understand and enhance the user experience, direct marketing, security, enforcement, and system integrity (prevention of hacks, unauthorized use, etc.).

  1. Information We Share

Pyoopl does not sell, rent, or trade your personal information with third parties other than as disclosed within this Privacy Notice. Pyoopl may share your information as set forth below or with your prior consent if required by applicable law.

  1. Service Providers, Agents and Contractors

Pyoopl may share users' information with our third party agents, contractors, or service providers who are hired to perform services on Pyoopl's behalf (collectively, “Providers”). These Providers may operate or support certain functions of the Services that we offer. Below is an illustrative list of functions for which we may use Providers and the names of the Providers we may use to perform these functions:

These Providers are only allowed to use the information shared with them for the specific tasks we have requested them to do and consistent with this Privacy Notice, and for no other purposes. Pyoopl takes steps to ensure that all Providers with access to personal information are capable of protecting the information we share with them.

  1. Public forums and community areas

We offer users the ability to use forums and similar means of public discussion. If you use any messaging, posting or chat functions on Pyoopl, you should be aware that any personal information submitted there will be available to anyone who has access to that content, including other users, and can be read, collected, or used by other users of these forums, and could be used to send unsolicited messages. We are not responsible for how other individuals use the information posted in this manner.

  1. Legal disclosures

We may disclose personal information about you as required or permitted by law and/or to comply with a judicial proceeding, court order, or legal process served on our Services. To the extent permitted by applicable law, we also may disclose personal data about you in response to a request from law enforcement agencies, regulators or other public agencies (including schools or children services) or if we believe such disclosure may prevent a crime, facilitate an investigation related to public safety or protect the safety of a child using our Services, protect the security or integrity of our Services, or enable us to take precautions against liability or to protect our rights.

  1. Business transfers

We may disclose or otherwise transfer information about our users, including personal data, to an acquirer, successor, or assignee as part of any merger, acquisition, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

  1. Anonymized Information

We share aggregated, automatically-collected or otherwise non-personal information with third parties for various purposes, including (i) compliance with reporting obligations; (ii) for business or marketing purposes; (iii) to assist us and other parties in understanding our users' interests, habits and usage patterns for certain programs, content, services, advertisements, promotions and/or functionality available through the Services. We do not share personal information about you in this case.

  1. Accessing and Modifying Information and Communication Preferences

If you have provided us any personal data, you may access, remove, review, and/or make changes to the same to the extent such permitted by the functionality of the App, or by contacting us as at contact@pyoopl.com. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases. You cannot opt out of receiving transactional e-mails related to the Services (e.g., requests for support).

We may also deliver notifications to your mobile device (e.g., push notifications). You can disable these notifications by deleting the relevant service or by changing the settings on your mobile device.

  1. Data Retention and Security

We retain personal data for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. We use the following criteria to determine our retention periods: the length of time we have an ongoing relationship with you and provide you with access to our Services; if there is a legal obligation to which we are subject; and whether retention is advisable in light of our legal position (such as statutes of limitation).

We employ procedural and technological measures that are reasonably designed to help protect your personal data from loss, unauthorized access, disclosure, alteration or destruction. Pyoopl may use firewalls, password protection, secure socket layer, database encryption, and other security measures to help prevent unauthorized access to your personal data.

  1. App Stores and External Websites

Your app store (e.g., iTunes or Google Play) may collect certain information in connection with your use of the Services, including, without limitation, personal data, Geolocational Information, and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.

On the Site, we may provide, for informational purposes only, links to other websites or resources with which we do not have a contractual relationship and over which we do not have control (“External Websites”). In addition, other users may post links to External Websites in connection with the use of the Services.  Such links are not paid advertisements, nor do they constitute an endorsement by Pyoopl of those External Websites, and are provided to you only as a convenience. By clicking on links to External Websites, the operators of the External Websites may collect your personal information. We are not responsible for the content or data collection practices of those External Websites, and your use of External Websites is subject to their respective terms of use and privacy policies.

  1. Notice to Users Outside the United States

The Services and its servers are operated in the United States. If you are located outside of the United States, please be aware that your Information, including your personal data, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to use the Services, you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States and elsewhere.
